New frontiers of arbitration: the challenges of the profession.

The world of arbitration is undergoing a phase of profound evolution, marked by two directions that may seem opposed but are in fact complementary..

These transformations will be the focus of the annual event organized by the Camera Arbitrale del Piemonte (the Piedmont Arbitration Chamber), titled “Business, civil justice, arbitration: what prospects?”, scheduled for 20 March 2026 at the Unione Industriali di Torino. The event will bring together experts, professionals and young legal practitioners to discuss the latest regulatory and cultural developments in the field.

We are witnessing a significant evolution in the culture of arbitration, developing along two main directions» comments Carlo Pavesio.

On one hand, there is the debate on the possible extension of corporate arbitration to listed companies, which are currently excluded from the legislation but are now the subject of discussion and reform proposals

On the other hand, the entry into force on 15 January of insurance arbitration – although not an arbitration in the strict sense – represents an alternative method of dispute resolution. It is a tool designed to reduce the burden on civil courts and to encourage agreements between policyholders and insurance companies, within still relatively limited economic thresholds. This outlines an expansion of arbitration’s user base, involving realities at opposite ends of the spectrum – from large listed companies to individual citizens – confirming a growing culture of arbitration as a complement to state justice.

To face these challenges, it is essential that arbitrators receive adequate training and are prepared to take on increasingly complex roles. Training must begin as early as possible so that new generations of professionals can acquire solid skills and a modern vision of arbitration.”

Arbitration is a dispute resolution tool that allows parties to entrust the decision of a case to one or more arbitrators, as an alternative to ordinary courts. It is characterized by generally faster timelines, streamlined procedures, and greater efficiency.
